Booking procedure
Your booking will be confirmed only when Voyage by Pascale (VBP or “we”) or an authorized agent has received your deposit within the time indicated on the invoice. Deposit requirements vary greatly with each hotel or villa. Reservations made within forty-five days (45) before departure must be paid in full immediately to confirm the reservations.
Prices and Surcharges
All prices are subject to change without notice, including transportation costs, government taxes, currency exchange rates, and hotel or villa price increases. In general, there will be no increases after final payment is made unless changes are made to the booking, but we cannot guarantee that there will be no increases.
Liability and Responsibility
VBP is not the source or supplier of the travel services being booked under these terms. Instead, it is acting solely as an agent for the actual suppliers of such services. VBP has no special knowledge or information regarding any supplier insolvency or unsafe conditions. The suppliers whose names appear in the information supplied are those who are responsible for providing these travel services. You understand and acknowledge that VBP is not responsible for: Any supplier failing to provide the travel services booked, failing to comply with any applicable rule, procedure or law, or committing any negligent act or failing to perform any act that causes any injury to person or property, damage, delay or other inconvenience.
Any conditions, actions, or omissions occurring that are beyond the reasonable and direct control of VBP.
Any travel disruptions, missed connections, cancelled flights, and/or other related problems that the party may experience.
Any cancellations or any changes to the vacation of the party due to war, threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions, technical or maintenance problems with transportation, changes of schedule or changes in operation decisions by airlines (resulting in cancellations or delays) or other circumstances amounting to force majeure; Any passport or visa problems any member of the party might experience in any country; Any changes the supplier makes to facilities or activities.
For information concerning possible dangers at destinations, VBP recommends contacting the Travel Warnings Section of the U.S. State Department at 202) 647-5225 or www.travel.state.gov. For medical information, VBP recommends contacting the Centers for Disease Control at (877) FYI-TRIP or www.cdc.gov/travel.
Each party must review carefully all travel documents for their accuracy. Failure to notify in writing VBP within 24 hours about discrepancies (names, number of travelers, dates, room type etc.) shall constitute a waiver of any claim regarding accuracy of the travel documents.
Cancellations, changes, and refund policy
Any party may cancel their booking at any time providing that they communicate the cancellation in writing to VBP. In case of late cancellation within penalties, VBP will try all possible to have penalties waived or offer a future credit, but guests must understand that this is at the good will of the hotel depending on dates of travel, circumstances and the economic impacts that will result from that cancellation.
Please note that your decision not to travel due to State Department advisories or fear of travel will constitute cancellation by you. Postponing or rescheduling of a trip is considered on a case-by-case basis but is in no way guaranteed. It is subject to the cancellation charges in the above paragraph. Refunds or changes after departure are at the discretion of the supplier of the service. It is your responsibility to inquire about supplier- related change and refund policies after departure. VBP will gladly assist in providing the supplier policies upon request. No refund or credit will be given for any unused features or early departures for any reason.
Important Information
Guests traveling internationally must have valid passport and any required visas. It is guest’s sole responsibility to make sure that their documents are in order. The information provided by VBP is based upon the latest information available at the resort, but changes (construction, closure, out of service) occur as suppliers update their facilities. VBP will update you about all the changes; however, it is possible that changes by a supplier can occur or begin to occur without the supplier notifying VBP.
Insurance
VBP strongly recommends the purchase of travel insurance to cover certain risks inherent in travel, including but not limited to supplier bankruptcy and the inability to travel due to a medical or personal emergency.
Complaints
If a problem arises during your vacation, please inform the hotel or villa as well as VBP management immediately, as this allows the supplier to act upon it right away. VBP will not accept any complaints that are voiced after your return where the supplier was unaware of difficulties. After you return, complaints that have not been resolved should be addressed in writing to the supplier, and VBP will act as a mediator between the two parties. If the complaint involves VBP, you must notify VBP in writing no later than two weeks after you return home; otherwise, VBP shall be relieved of any and all liability for the problem. You agree to accept any reasonable solution VBP makes in an attempt to amicably settle any problem or complaint. You agree that the courts in New York City will be the exclusive forum for all suits brought by you, and you hereby submit to the personal jurisdiction of those courts.
